When parents split up, they can come to an agreement about child custody and visitation. Parents can sign an agreement on where their child(ren) will reside after their split-up or divorce.
When parents fail to reach an agreement, they go to court. When the court makes a ruling regarding child custody, it always considers what is in the "best interests" of the child. Opinion of a child of ten years or older must be considered, unless it is adverse to his/her interests. It is worth noting that pecuniary advantage of a parent is not accepted as an absolute reason for satisfaction of such parent’s demands.
