A prenuptial agreement is a way to determine a marital property regime before the dissolution of a marriage.

A prenuptial agreement is a contract entered into prior to marriage, civil union or any other agreement prior to the main agreement by the people intending to marry or contract with each other.  The contents of a prenuptial agreement can vary widely, but commonly includes provisions for division of property and spousal support in the event of divorce or breakup of marriage.

When a prenuptial agreement is executed before the state registration of marriage, it comes into force on the date of state registration of marriage.

In any case, a prenuptial agreement must be executed in writing and notarized.

Although the contents of a prenuptial agreement can vary widely, one must not forget that such agreement regulates only property rights and obligations of spouses rather than personal rights thereof.

By means of a prenuptial agreement spouses may change the statutory regime of matrimonial property and to apply the scission regime either to the entire matrimonial property or to its certain items or to the individual property of each spouse.  Such agreement may cover either the present or any future property of spouses.

A prenuptial agreement may help spouses to determine their spousal support rights and obligations, profit and cost-sharing schemes, the property to be divided in case of divorce and any other property relations.

A prenuptial agreement terminates upon the annulment of marriage, save for surviving obligations thereof.  At any time, spouses may, by mutual consent, amend their prenuptial agreement subject to notarizing.  A prenuptial agreement may be terminated either by consent of both parties or by judicial procedure.

If spouses have never signed a prenuptial agreement, they may execute a postnuptial agreement which regulates all of the aforementioned issues.
